These Terms of Service ("Terms") govern your access to and use of putthem.in ("we," "our," "us," or the "Platform"). By using putthem.in, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. What putthem.in Does
putthem.in is a web-based platform that allows users to upload a photo of a person, remove the background, and turn that person's face into a playable character in a personalized arcade game. The resulting game is accessible via a unique shareable link and is intended as a fun, shareable gift.
2. Eligibility
You must be at least 13 years old to use putthem.in. By using the Platform, you represent that you meet this requirement. If you are under 18, you should have the consent of a parent or legal guardian.
3. User Responsibilities
3.1 Photo Consent
By uploading a photo, you confirm that:
- You are the person in the photo, or you have the explicit consent of the person in the photo to use their likeness in a game.
- The photo does not depict a minor in any suggestive context.
- You have the legal right to use and submit the image.
We are not responsible for disputes arising from unauthorized use of someone's likeness. Any such disputes are solely your responsibility.
3.2 Acceptable Use
You agree not to use the Platform to:
- Upload images of non-consenting individuals for purposes of harassment, humiliation, or abuse
- Upload nudity, sexually explicit content, or graphic violence
- Impersonate any person in a defamatory or harmful way
- Circumvent our content moderation systems
- Attempt to reverse-engineer, scrape, or disrupt the Platform
- Use the Platform for any unlawful purpose
Violations may result in removal of your game and/or permanent access restrictions.
4. Purchases
4.1 One-Time Payment
Access to generate and share a game requires a one-time payment. Pricing is displayed at checkout.
4.2 Digital Goods
All purchases are for digital goods delivered immediately upon payment. Please review our Refund Policy before purchasing.
4.3 Payment Processing
Payments are processed by Lemon Squeezy, our merchant of record. By purchasing, you also agree to Lemon Squeezy's terms and policies.
5. Intellectual Property
5.1 Your Content
You retain ownership of any photos you upload. By submitting them, you grant us a limited, non-exclusive license to process and display the content solely to provide the service.
5.2 Our Content
All game assets, code, designs, branding, and the Platform itself are the intellectual property of putthem.in. You may not copy, reproduce, or redistribute them without our written permission.
5.3 Generated Games
The personalized game generated for you is licensed for personal, non-commercial use and sharing. You may not resell, sublicense, or commercially exploit the generated game content.
6. Content Moderation
We reserve the right to review, restrict, or permanently delete any game at our sole discretion if we determine it violates these Terms, our Acceptable Use Policy, or applicable law. This includes but is not limited to content involving nudity, harassment, or illegal material. Deletion may occur without prior notice.
7. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be error-free, uninterrupted, or meet your specific expectations.
We are not responsible for how shared game links are used, distributed, or received by third parties.
8. Limitation of Liability
To the maximum extent permitted by law, putthem.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to loss of data, reputational harm, or damages resulting from third-party misuse of a shared game link.
Our total liability to you for any claim arising from use of the Platform shall not exceed the amount you paid for the transaction in question.
9. Indemnification
You agree to indemnify and hold harmless putthem.in and its operators from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your uploaded content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. Governing Law
These Terms are governed by the laws of the Republic of Armenia. Any disputes shall be subject to the jurisdiction of the competent courts of Armenia.
12. Changes to These Terms
We may update these Terms from time to time. Changes take effect upon posting. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
